Konrad Żelazowski - Identification of Price Bubbles in Local Housing Markets in Poland Using the GSADF Test

In the years 2006-2008 the Polish housing market experienced an above-average increase in property prices. This initiated a discussion on the causes and nature of the observed price phenomenon. The article tries to answer the question whether there was indeed a price bubble in the housing markets in Poland. In the research housing markets of voivodeship capital cities were investigated in the period 2003-2016. The GSADF test proposed by Phillips, Shi and Yu was applied to detect the price bubbles. The test procedure covered P/I (price/income) ratios estimated for individual local markets.

Ewelina Regulska - The Importance of the Rental Housing Market and Prospects for its Development

In the era of a changing society the importance of the rental market in meeting housing needs is growing. The increasing significance of this segment is influenced not only by the dynamically changing labour market and the associated occupational mobility but also by recent experiences related to the global crisis. These events showed that a well-developed rental market is able to ensure an economic stability. The rental market is important not only from the point of view of the economy but also the entire society. In Poland, this sector is not as developed and large as in other European countries. Even overnment housing programmes introduced in the 1990s did not significantly contribute to the development of the rental market. Despite this, the prospects for the development of this residential segment are optimistic. The current government program ‘Mieszkanie Plus’ is one of the elements that could significantly impact the further development of this market.

Konrad Turkowski - Water and Real Estate – Selected Aspects of their Interrelatedness

The article concerns multi-layered relations between real estate and water. The ownership rights of water and land under the water as well as rules of their marketing were presented in the light of current legal regulations. Areas of limited real estate development and use caused by special water protection and flood risk were showed. Attention was paid to additional real estate maintenance costs arising from a use of water services in relation to disposal of rain-, meltwater, and water from land drainage within cities as well as from decreased natural area water retention.

Zofia Kuryśko - The Aim of Perpetual Usufruct in Enfranchisement Decisions with Regard to Implementation of an Investment Process

The article describes the origin, the purpose and the character of the perpetual usufruct law. It presents current legal and investment problems pertaining to defining the purpose of perpetual usufruct in enfranchisement decisions when studying compliance with investment plans implemented by perpetual leaseholders in the present-day realities. The article indicates the procedure according to which the wording of the law of perpetual usufruct can be amended. It describes claims of land owner in case of evident contradiction between the perpetual leaseholder’s usage of the property and the purposes specified in the contract. The article also talks about difficulties related to the dissolution of the right of perpetual usufruct.

Magdalena Frańczuk – Noise as an Immission into Neighbour's Property and the Right to Quiet Inhabitancy

The article analyses the current problem of immission onto the neighbour’s property in Poland and abroad as well as ways to combat onerous behaviour of people living in premises or neighbouring properties and entering into the home order in an unauthorised manner. The problem of neighbourly immissions is presented on the example of noise. Other types of immissions have been omitted in the study due to the fact, that in today's world noise seems to be the most common type of disturbance of neighbourly law. The right to peaceful inhabitancy was treated as a typical kind of personal good which is subject to the civil law protection. The aim of the article is therefore to analyse the problem of immissions of a neighbour’s noise and to propose effective and legal methods of combating this type of immission. The article focuses on the civil law and the misdemeanours law in the realm of the neighbourly law. As a result of the research findings several comments of the de lege lata nature and the de lege ferenda demands were presented, the implementation of which should effectively protect the right to quiet inhabitancy. Presenting the research results synthetically, it should be stated that in practice the only effective solution for the fight against noise immissions should be the development of appropriate good neighbourly customs and an effective use of existing rights of legitimate services such as the Police or Municipal Police.
